Terms of Service

01 — Acceptance of terms

Creating an account, accessing the app, or any use of the marketplace constitutes acceptance of these Terms. We may update these Terms from time to time; material changes will be communicated through the app. Continued use after changes take effect constitutes acceptance of the revised Terms.

02 — Eligibility & accounts

• You must be at least 18 years old and legally capable of entering into binding contracts.
• You must provide accurate, complete registration details, including a valid phone number.
• You are responsible for keeping your account credentials secure and for all activity under your account.
• Each business may hold one account; creating fake, duplicate, or misleading accounts is prohibited.
• Trami reserves the right to verify business information and to suspend accounts that fail verification.

03 — Marketplace rules

Trami connects buyers and suppliers within a local radius to facilitate wholesale transactions. By using the service you agree to:

• List only products or services you genuinely can supply, with accurate descriptions, prices, and stock status.
• Post wanted requests only for goods you genuinely intend to purchase.
• Honour accepted offers: delivery, price, quantity, and timing agreed with a counterpart.
• Communicate professionally and refrain from harassment, spam, abusive language, or misleading behaviour.
• Not circumvent, undermine, or disparage the marketplace or other users.
• Not attempt to scrape, reverse-engineer, or interfere with the app, its data, or other users' accounts.

04 — Bids, offers & transactions

A bid or offer is a non-binding expression of interest until accepted by the other party. Once accepted, you agree to complete the transaction in good faith under the terms agreed. Trami facilitates introductions between traders but is not a party to the buyer–supplier contract. You transact at your own risk; Trami is not responsible for the quality, delivery, or fulfilment of goods traded between users.

05 — Prohibited conduct

You may not use Trami to:

• List prohibited, illegal, counterfeit, stolen, or otherwise unlawful goods.
• Post false, deceptive, or fraudulent listings, requests, or offers.
• Impersonate another person or business.
• Harass, threaten, defame, or intimidate any user.
• Send unsolicited commercial messages (spam) through the platform.
• Facilitate money laundering, fraud, or other criminal activity.

06 — User content & moderation

You retain ownership of the listings, requests, bids, and messages you post, and grant Trami a license to host, display, and process that content solely to operate the marketplace. You warrant that your content does not violate any third-party rights or these Terms.

Trami may review, moderate, or remove content that violates these Terms and may suspend or terminate accounts of users who repeatedly violate them. We provide reporting and blocking tools so users can flag spam, inappropriate content, fraud, or harassment and restrict contact with other traders. Reported content may be acted upon at our discretion.

• Reporting: use the report option on any product, request, bid, or conversation to flag abuse.
• Blocking: blocked traders can no longer see your content or contact you.
• Removal: content that violates these Terms may be removed without notice.

07 — User content license

By posting content on Trami, you grant us a non-exclusive, worldwide, royalty-free, sub-licensable license to use, reproduce, modify, adapt, publish, and display such content as reasonably required to provide, promote, and improve the service. This license continues while your content remains on the service.

08 — Subscription & payment

Access to active trading features may require a paid subscription. Subscriptions are billed via M-Pesa STK push; you authorise us to initiate payments through M-Pesa (Safaricom Daraja). Payments are generally non-refundable. Unpaid or expired subscriptions suspend active trading features until renewal.

09 — Privacy summary

Your privacy matters to us. We collect account details, approximate location, and trading activity to operate and match you with nearby traders. We never store your M-Pesa PIN, and we do not sell your personal data. Your shop name, location, and phone number may be visible to other traders you transact with. 10 — Intellectual property

The Trami name, logo, app, and website, including their design, code, and content, are owned by Trami Traders Network or its licensors and are protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works from them without our prior written consent.

11 — Disclaimers & limitation of liability

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Trami shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or opportunities, arising from your use of the service or from transactions between users.

12 — Termination

You may stop using Trami at any time. We may suspend or terminate your account without notice if you breach these Terms, engage in fraudulent or abusive behaviour, or if we are required to do so by law. Upon termination, your right to use the service ends; sections that by their nature survive termination (including disclaimers and limitation of liability) continue to apply.

13 — Governing law

These Terms are governed by the laws of the Republic of Kenya. Disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya. Nothing in these Terms limits any consumer protections that cannot be waived by law.
